How We Value Your Claim

If you’ve suffered an injury due to someone else’s negligence, you have the right to pursue compensation and will be referred to as the “claimant.” While you can handle the claim on your own, special rules apply if the injured person is under 18 or unable to manage their own legal affairs. In such cases, the court appoints a “litigation friend” to act on their behalf. A litigation friend is often a family member, guardian, or trusted friend.

Beacon Law can assist claimants with a range of cases and injuries. Some of the most common legal matters which we deal with on a no win, no fee basis, include, but are not limited to, the following:

If you have sustained an injury in any type of accident as a result of someone else’s negligence, you may be able to make a claim for compensation. Get in touch today to find out if we can help and how we value your claim.

Compensation

It is difficult to predict how much your claim is worth without having all of the details of your injuries and the circumstances surrounding the accident. We typically base our estimates off the Judicial College Guidelines and our past case experience with similar injuries. If you have suffered a personal injury, you can claim two types of compensation, these are known as general damages and special damages.

General Damages

General damages are designed to compensate you for the pain, suffering, and loss of amenity suffered by you as a result of your accident. Often the amount of general damages will depend upon the severity and type of injuries and the extent of your symptoms or disability.

Special Damages

Special damages are to compensate for any other financial losses that you incur as a result of being injured. You can claim for any past or future losses, but in most circumstances you will be required to produce evidence of the expenses. The most common types of special damages include loss of earnings, any medical or rehabilitation treatment, care and assistance, travel expenses, vehicle repairs, hire costs, and damage to personal property.

You should always try to keep a record of your expenses, and wherever possible, obtain receipts or invoices. If at any stage you believe you may need to incur any future expenses, please do speak with us to discuss this. In relation to any claim for loss of earnings, we will normally request that you provide us with your employer’s details in order that we may request the necessary information from them.
