No Win, No Fee Injury Lawyers, Manchester

We are proud to say that we work on a ‘no win no fee’ basis. This means that you are unlikely to be required to pay any fees if your case is unsuccessful. If your case is successful, our success fee will be deducted from your damages on conclusion of your case. The success fee is capped at 25%.

We always offer our no win, no fee agreement in conjunction with an ATE insurance policy so that you will not incur any personal liability for your opponent’s costs if the claim were to fail.

If you lose, you will not be required to pay for the insurance. If your claim is successful, you will be responsible for the payment of our success fee and the insurance premium which would be deducted from your final award of compensation.

More details can be provided around our retainer and ATE insurance premium during your initial consultation. Have a look at our funding section for more details.

Making a Personal Injury Claim

If you’ve suffered an injury due to the negligence of a third party – such as your employer, a driver, a property owner, a council, or a healthcare provider – you may be eligible to claim compensation.

To protect your rights, it’s important to act promptly. You generally have three years from the date of the accident to file a claim. Delaying could risk missing the legal deadline and losing your right to compensation.

The amount of compensation you may receive depends on several factors, including:

  • Severity of Your Injuries: The extent of your physical and psychological injuries will significantly impact the claim.
  • Impact on Your Life: The long-term consequences of the accident, such as pain, suffering, and loss of quality of life, will be considered.
  • Financial Losses: Any additional financial losses, such as medical expenses, lost earnings, and property damage, will be factored into the claim.

Time limits for making a claim

In England and Wales, the general time limit for making a personal injury claim is three years from the date of the injury or from the date you became aware that your injury was linked to someone else’s negligence (known as the “date of knowledge”).

Key Exceptions to the 3-Year Limit:

  1. Minors (under 18 years old): If the injured person is under 18, the 3-year time limit begins on their 18th birthday. This means they have until their 21st birthday to file a claim.
  2. Mental incapacity: If the injured person lacks the mental capacity to handle their own affairs, there is usually no time limit until they regain capacity.
  3. Criminal Injuries Compensation: For injuries resulting from criminal acts, you generally have 2 years to make a claim through the Criminal Injuries Compensation Authority (CICA).

Compensation amounts

If you are successful in your personal injury claim, you could receive compensation for both general damages and special damages.

General damages are awarded to compensate you for the pain, suffering, and loss of amenity caused by your injuries. The amount awarded will depend on the severity of your injuries and their impact on your life.

Special damages are awarded to compensate you for any financial losses you have suffered as a result of your injuries. This could include:

  • Medical expenses, such as any private hospital bills and medication costs
  • Loss of earnings, if you have been unable to work due to your injuries
  • Care costs, if you need help with daily living tasks
  • Travel expenses, if you have had to travel for medical treatment
  • Property damage, if your property was damaged in the accident

The amount of compensation you could receive will depend on the specific circumstances of your case. It is important to speak to a lawyer to get an accurate estimate of how much you could claim.
