The personal injury claim process
Once you contact us, you will speak with an experienced personal injury solicitor. Our no win, no fee lawyers UK will ask you for quite a lot of information during this initial consultation, which will help them assess the prospects of succeeding in your claim. Examples of relevant information may be:
- The location, time, and date of the accident
- The accident circumstances
- The nature of the injuries sustained
- Details of any independent witnesses who may have witnessed your accident
- Details of the negligent party (the defendant)
If, after speaking with you, we are happy to proceed with your claim on a “no win, no fee” basis, we will arrange for a representative of the firm to visit you at your home address to assist you with our initial paperwork. Once we are in receipt of your signed documents, we shall proceed to contact the defendant and advise them of your claim.
Depending upon the nature of your accident, the defendant has up to 5 months to investigate your claim and provide their decision on liability.
Whilst awaiting the defendant’s liability decision, your personal injury solicitor will begin to gather the information needed to prove your case. This could include taking witness statements from you and other parties involved in the accident, obtaining a relevant police report, and instructing a suitable medical expert to prepare a report on your accident related injuries.
Making a No Win, No Fee Claim
Beacon Law offer our services on a no win, no fee basis. A no win, no fee agreement is used to fund a compensation case where the victim of the accident does not have the means or does not wish to pay upfront, the costs involved as the case progresses. It can also be used where the victim does not wish to have the financial risks involved in making a claim.
If we believe your case has a chance of success, we will normally agree to proceed with a ‘no win, no fee’ agreement. One of the most important things to remember about a ‘No Win, No Fee’ Agreement is that if you are not successful in your claim, then you will not be required to pay our fees.
When you start your no win, no fee claim with us, you will be required to sign an agreement called the Conditional Fee Agreement (CFA), which states that you agree to pay our fees if your claim is successful.
The best thing about making a no win, no fee claim is that the financial risks of litigation are minimised. If your claim is unsuccessful, in most cases, you will not be required to pay any legal fees. If your claim is successful, we will deduct our fees from your compensation when your claim has been resolved.
How your claim will be valued
General Damages – General damages are designed to compensate you for the pain, suffering, and loss of amenity suffered by you as a result of your accident. The amount of general damages will depend upon the severity of your injuries and the extent of your symptoms.
Special Damages – Special damages are the other losses that you incur as a result of being injured. You can claim for any past or future expenses, but in most circumstances, you will be required to produce evidence of the expenses. The most common types of special damages include loss of earnings, any medical or rehabilitation treatment, care and assistance, travel expenditure, vehicle repairs, hire costs, and damage to personal property.
You should always try to keep a record of your expenses and, wherever possible, obtain receipts or invoices. If at any stage you believe you may need to incur any future expenses, please do speak with us to discuss this. In relation to any claim for loss of earnings, we will normally request that you provide us with your employer’s details so that we may request the necessary information from them.
Who Will Be Responsible for My Case?
Your case will be given to one of our personal injury solicitors, who will conduct your claim from start to finish. Your solicitor may delegate certain tasks relating to your case to other individuals within the firm. You will be advised of your solicitor’s name and contact details at the outset of your claim, and they will work with you every step of the way throughout the claims process.
Your claim is subject to constant supervision from one of the firm’s partners, and in the event your assigned solicitor cannot answer your queries, or you are concerned about something relating to your case, you should not hesitate to contact the supervising partner.
What is legal expenses insurance?
Throughout the litigation process, legal costs and fees will always be incurred. Costs such as court fees, expert fees, and costs of obtaining medical records may need to be paid. Although you may not be required to pay our fees if you lose your claim, you may be held personally responsible for payments of your opponent’s costs and expenses. By taking out a legal expenses insurance policy, you will ensure that you are not personally liable for these costs.
There are two types of Legal Expenses Insurance: Before the Event (BTE) Insurance and After the Event (ATE) Insurance. Most personal injury claims can be covered by After the Event Insurance if your claim is unsuccessful.
You will only have to pay the costs of After the Event Insurance if your claim is successful. If your claim is unsuccessful, your fee will be waived.
