Making A No Win, No Fee Claim
Beacon Law, No Win, No Fee Solicitors, Norwich offer our services on a no win, no fee basis. A no win, no fee agreement is used as a way of funding a compensation case where the accident victim does not wish to pay the costs involved as the case progresses upfront.
If our personal injury solicitors believe your case will be a success, we will usually agree to proceed with your case under a no win, no fee agreement. One of the most important features of a no win, no fee agreement is that if you do not succeed in your claim, you will not be held liable for any costs to this firm for our fees.
When you start your no win, no fee claim with us, you will be required to sign a Conditional Fee Agreement (CFA) which means that you agree to pay our fees, but only if your claim is successful.
The main benefit of making a No Win, No Fee claim for compensation is that the financial risks of litigation are reduced. In most cases, you will not be required to pay any legal fees if your claim is unsuccessful. If your claim is successful, we will deduct our fees from your compensation when your claim has been settled.
Our Fees If Your Claim Is Successful
If your claim is successful, you will be required to pay our success fee. This will be calculated as a percentage of your final compensation amount and will be taken at the end of your case. If you win your case, you may also be required to pay a sum for legal expenses insurance.
What Is Legal Expenses Insurance?
Costs and fees will always be incurred throughout the litigation process. The main costs incurred may include costs of obtaining medical records, expert fees, court fees. Although you may not be required to pay our fees if you lose, you may be personally responsible for the payment of your opponent’s costs and expenses. Taking out a legal expenses insurance policy will ensure that you are not held personally liable for these costs.
There are two types of Legal Expenses Insurance; Before the Event (BTE) Insurance and After the Event (ATE) Insurance. After the Event Insurance may be required for a large number of personal injury claims to cover the costs of the claim if it is unsuccessful.
You will only be required to pay the costs of ATE Insurance if your claim is successful; if your claim is unsuccessful, this fee will be waived.
Circumstances When You May Be Required To Pay Our Fees
Although uncommon, there are some circumstances where you may be held responsible for ours and the Defendant’s fees and costs. For example:
- If you don’t provide us with instructions or fail to co-operate with us in any way, we will hold you to be in breach of the No Win, No Fee Agreement.
- Only in certain situations you may still be responsible for our fees even if you win. This situation would only arise if your opponent cannot recover all the costs to us. However, we will try and make sure that you recover most, if not all, of the costs from your opponent.
- If you are found to be fundamentally dishonest at any point of the claim. This can include providing any information regarding the claim, which you know to be false. Dishonesty, such as exaggerating injuries, providing inaccurate information about the accident, or failing to inform us of any information, such as previous accidents or injuries, will cause you to be in breach of the No Win, No Fee Agreement.
- If you wish to end your No Win, No Fee Agreement early, you will have no obligation to pay our basic costs unless you agree to wait for your claim results.
