Making a No Win, No Fee Claim

Beacon Law No Win, No Fee Solicitors Leeds, offer claims on a No Win, No Fee basis. A  No Win, No Fee agreement/ Conditional Fee Agreement is used as a way of funding a compensation case where the victim in the accident does not wish to pay upfront for legal assistance and does not want the financial risks which may arise by making a claim.

If we believe your case will be a success, we will usually agree to carry your case under a No Win, No Fee Agreement.  One important factor of a No Win, No Fee Agreement is that, if your case does not succeed in your claim, then you will not be liable to this firm for our fees.

When starting your claim, you will be required to sign a Conditional Fee Agreement (CFA) which means that you agree to pay our fees, but only if the claim is successful.

The main advantage of a No Win, No Fee claim for compensation is that the financial risks of litigation are reduced. In most cases you will not need to pay any legal fees if your claim is unsuccessful. If your claim is successful, we will deduct our fees from your compensation award when your case has been settled.

Our Fees if you Claim is Successful

If you are successful in your claim, you will be required to pay our success fee. This is a percentage of your final compensation amount, and will be deducted when the case has been settled. If you win your case, you may be required to pay an amount for legal expenses insurance.

What is Legal Expenses Insurance?

Costs and fees will always occur throughout the litigation process. The main costs incurred may include: Expert fees, obtaining medical records, and Court fees. If you lose, you may not be required to pay our fees, however, in some circumstances, you may be required to pay your opponents costs and expenses. Taking out a Legal Expenses Insurance policy will ensure you are not held personally liable for these costs.

There are two types of legal Expenses Insurance; before the Event (BTE) Insurance and After the Event (ATE) Insurance. After the Event Insurance may be required to cover the Defendant’s costs of your claim is unsuccessful.

You will only be required to pay the After the Event Insurance cost if you claim was successful. If you were unsuccessful, this fee will be waived.

Circumstances when You May be Required to pay Our Fees

There may be some circumstances where you may be held responsible for ours and/or the Defendant’s fees and costs. For example:

• If you are found to be dishonest at any point during the process. This can include providing any false details regarding the claim which you know to be untrue, and can include exaggerating injuries, proving inaccurate information about the details of the accident, or failing to tell us about any previous information, such as previous accidents or injuries.
• In the event that you fail to provide adequate instructions or co-operate with us in any way, we would hold you to be breaking your ‘No Win, No Fee’ Agreement.
• You may also be responsible for some of our fees after you win. This situation may arise if we cannot recover all of our costs from the opponent. However, in the event of a successful claim, we would hope you would recover most if not all of our costs from your opponent.
• In the unlikely event that you should wish to end the ‘No Win, No Fee’’ Agreement before the settlement of your case, you will have an obligation to pay our basic cost, unless you agree to wait until the settlement of your case.
