Making a No Win, No Fee Claim

At Beacon Law, we offer our services on a no win, no fee basis. A no win no fee compensation claim, also known as a “conditional fee agreement” (CFA), is a funding option which allows individuals to make a compensation claim without having to pay any legal fees upfront. Instead, the legal fees are only paid if the claim is successful.

When starting your claim, you will be required to sign a Conditional Fee Agreement (CFA) which means that you agree to pay our fees, but only if the claim is successful.

The main advantage of a no win, no fee claim for compensation is that the financial risks of litigation are reduced. In most cases you will not need to pay any legal fees if your claim is unsuccessful. If your claim is successful, we will deduct our fees from your compensation award when your case has been settled.

Our Fees if Your Claim is Successful

If you are successful in your claim, you will be required to pay our success fee. This is a percentage of your final compensation amount, and will be deducted when the case has been settled. If you win your case, you may be required to pay an amount for legal expenses insurance.

What is Legal Expenses Insurance?

A CFA may include an “After the Event” (ATE) insurance that covers the risk of losing the case and the cost of the expenses incurred in the case, such as medical reports, court fees, and other expenses. The cost of the ATE insurance will be payable by the claimant on conclusion of their case; but only if their case is successful.

It’s always advisable to seek legal advice from a solicitor before entering into a CFA, to understand the terms and conditions of the agreement, and to ensure that you fully understand the potential costs involved if the claim is not successful.

You typically will only be required to pay the After the Event Insurance cost if you claim was successful. If you were unsuccessful, this fee will be waived.

Circumstances When You May be Required to Pay Our Fees

There may be some circumstances where you may be held responsible for ours and/or the Defendant’s fees and costs. For example:

• If you are found to be dishonest at any point during the process. This can include providing any false details regarding the claim which you know to be untrue, and can include exaggerating injuries, proving inaccurate information about the details of the accident, or failing to tell us about any previous information, such as previous accidents or injuries.
• In the event that you fail to provide adequate instructions or co-operate with us in any way, we would hold you to be breaking your ‘No Win, No Fee’ Agreement.
• You may also be responsible for some of our fees after you win. This situation may arise if we cannot recover all of our costs from the opponent. However, in the event of a successful claim, we would hope you would recover most if not all of our costs incurred from your opponent.
• In the unlikely event that you should wish to end the ‘No Win, No Fee’’ Agreement before the settlement of your case, you will have an obligation to pay our basic cost, unless you agree to wait until the settlement of your case.
