Making a No Win, No Fee Claim

A no win, no fee agreement is used to fund a compensation case where the victim of the accident does not have the means to pay the costs involved as the case progresses. It can also be used where the victim does not wish to have the financial risks involved in making a claim.
If we believe your case has a chance of success, we will normally agree to proceed with a ‘no win, no fee’ agreement. One of the most important parts to remember about a ‘No Win, No Fee’ Agreement is that if you are not successful in your claim, then you will not be required to pay our fees.
When you start your no win, no fee claim with us, you will be required to sign an agreement called the Conditional Fee Agreement(CFA) which states that you agree to pay our fees if your claim is successful.
The best thing about making a no win, no fee claim is that the financial risks of litigation are minimized. If your claim is unsuccessful, in most cases, you will not be required to to pay any legal fees. · In the event where you fail to provide proper instructions or fail to co-operate with us in any way, we would hold you in breach of the ‘No Win, No Fee’ Agreement.
· If you are found to be fundamentally dishonest at any stage of the claim, such as proving untrue information about the claim, over-exaggerating injuries, proving false or inaccurate details about the accident, or failing to inform us of any past information, such as previous accidents or injuries.
· You may also be responsible for some of our fees if you win. This may arise if the opponent doesn’t agree to cover all our costs. However, in the event of a successful outcome, we would hope to recover the majority of our legal costs from your opponent.
