If you are currently being represented by a solicitor or legal professional on a case, you may have asked yourself the question “can I change my solicitor?” The answer to this question is yes, if you are not completely satisfied with the work being carried out by your solicitor, you are more than welcome to switch solicitor. Even if your claim is funded by legal expenses insurer, it is your right to change.

Common Reasons For Changing Your Solicitor

Whether a client is being represented by a legal professional on a personal injury compensation claim, professional negligence claim, family law case, or any other legal matters, they are entitled to chose an alternative firm of solicitors to deal with their case if they wish to do so. The most common reason for this include:

  • not being kept updated on the progress of a case by your current solicitor
  • losing trust in your current solicitors, for example, they may have provided poor legal advice or dealt with your claim in an unprofessional manner
  • receiving a poor service from your current Solicitors

You should be aware that, just because your solicitor is not telling you everything that you want to hear, doesn’t necessarily mean that they are doing a poor job on your case. For example, if they have advised you that your injuries are worth less that what you believe they are worth, it may be the case that the solicitors valuation is more accurate than the amount that you believed your injuries were worth. A new solicitor will be unable to increase the valuation of your injuries if the previous solicitor’s valuation was correct.

Can I Change Solicitors Halfway Through a Claim?

You can change your solicitor at any point of the claims process. When you have chosen the new law firm which you would like to deal with your case, they will request your files from your previous solicitor so that they can pick up from the point you decided to switch Solicitors.

If you are sure that you would like to change solicitors, it may be better to change your solicitors as early into the claim as possible. This will make it easier and quicker for your new Solicitor to start working on your case without any important information being lost or pissed in the transfer process.

How to Change Solicitors

The process of changing solicitors is actually quite simple; however, you should take time when choosing your new Solicitor to make sure that they are right for you. If you decide to switch Solicitors to Beacon Law, we will make the process as easy as possible for you.

We will send you all the relevant paperwork to complete and return to us. The paperwork will include our conditional fee agreement and a form of authority. When we have received your signed form of authority, we will be able to request your file from your previous solicitors.

In some cases, it may take some time for us to obtain your files from the previous firm of Solicitors as it is their responsibility to send everything to us. We will ensure that we chase the previous firm regularly and will take the appropriate steps necessary if we encounter any difficulties in retrieving your files.

How to Choose the Right Solicitor

If you are interested in changing solicitors, you should be sure that the new firm will be better suited to your needs. You should take some of the following steps to find out if your new potential firm of solicitors is right for you:

  • Research the company – are they a large national form or a small local firm?
  • Speak to your Solicitor before agreeing to proceed. Many firms, such as Beacon Law will offer a free, no obligation phone call to help you make your decision.
  • Ensure that your new firm of solicitors is authorised and regulated by the Solicitors Regulation Authority (the regulators of Solicitors in England and Wales)

How Much Will Changing My Solicitor Cost?

In most cases, it will not cost you anything to change your solicitor. Your new Solicitor will usually come to an agreement with your previous Solicitor to cover the costs of any work done on the file and would agree to pay the costs at the end of your case.
