Crush injuries occur when a body part is subjected to significant compressive forces, often resulting from accidents such as motor vehicle collisions, industrial mishaps, natural disasters, or heavy object collapses. These injuries can range in severity from mild soft tissue damage to life-threatening complications involving multiple organ systems.

If you or a loved one has suffered from crush injuries due to someone else’s negligence, you may be entitled to compensation. This compensation can help ease the financial burden of medical treatment, rehabilitation, lost wages, and the emotional toll of living with such a significant injury.

Please get in touch with our expert team at Beacon Law to discuss how we can assist you in making a crush injury claim.

Common accidents that lead to crush injuries

Crush injuries often result from high-impact or compressive accidents, many of which lead to legal claims for compensation due to negligence, unsafe working conditions, or improper safety measures. Common scenarios include:

Workplace accidents

    • Construction site incidents: Collapsing scaffolding, falling objects, or equipment malfunctions can result in crush injuries, especially to limbs or the torso.
    • Industrial machinery: Improper use, lack of safety guards, or equipment failures (e.g., conveyor belts, presses) can trap and crush body parts.
    • Forklift or heavy vehicle accidents: Workers can be pinned between vehicles and structures, causing severe injuries.

Road traffic accidents

    • Car accidents: Rollovers or collisions can crush limbs or other parts of the body, particularly when passengers are trapped in wreckage.
    • Truck accidents: Larger vehicles pose a high risk of causing crush injuries due to their size and weight.
    • Pedestrian accidents: Pedestrians struck by vehicles may suffer severe compressive trauma.

Falling objects

    • Accidents involving heavy items falling from shelves, cranes, or elevated surfaces often lead to claims, especially if proper safety precautions were not followed.

Agricultural accidents

    • Incidents involving heavy farming machinery like tractors or harvesters often result in severe crush injuries to workers.

Defective Products

    • Malfunctioning consumer products or tools, such as poorly designed exercise equipment or car jacks, can cause crush injuries, leading to product liability claims.

Common crush injuries

  • Soft Tissue Damage
  • Compartment Syndrome
  • Bone Fractures
  • Nerve Damage
  • Vascular Injury
  • Crush Syndrome (Traumatic Rhabdomyolysis)
  • Internal Organ Damage
  • Amputation
  • Skeletal muscle injury
  • Acute kidney injuries

What is the crush injury claims process?

During your initial consultation, an injury lawyer from our team will provide you with legal advice about crush injury and crush syndrome claims and will inform you about the relevant limitation rules.

Our personal injury lawyers will then ask you for details about your accident and the initial crush injuries that were suffered as a result. This will help us to assess the likelihood of your claim being successful.

In the early stages of your claim, it’s essential to gather evidence to support your case. This may include CCTV footage of the incident, medical records, accident reports, photographs of your injuries, and witness statements.

Your injury lawyer may also request that you undergo an independent medical examination to obtain a detailed report on the nature and extent of your injuries. These medical reports serve as crucial evidence for your claim. Even if you’ve already received emergency medical care, a more comprehensive assessment may still be required to ensure the reports are accurate, thorough, and reliable.

If we think that your accident claim would be likely to succeed, we will offer a no win, no fee basis; if your claim is unsuccessful, you will not be required to pay any legal fees.

What are the time limits for crush injury claims?

Before starting your claim, it is important to note that there are strict time limits on personal injury claims. From the date of the accident that caused the injuries, the injured party will have 3 years to commence proceedings for claiming compensation.

It must be noted, however, that there are some exceptions to this rule:

For instance, if the claimant was under 18 at the time of the incident, they have until their 21st birthday to file a compensation claim. If the claimant is still under 18, a litigation friend (such as a parent, guardian, or close family member) can pursue the claim on their behalf.

Another exception to the three-year time limit applies when the claimant lacks the mental capacity to start an accident claim. In such cases, the three-year limit does not apply. The claimant can initiate their claim at any point once they regain the mental capacity to proceed.
